El fiscal general adjunto a investigar el programa UndocuPack

El Departamento de Justicia de los Estados Unidos envió una carta el viernes 26 de septiembre a la secretaria de Educación de los Estados Unidos, Linda McMahon, en la que anunciaba que había recibido informes sobre la oficina UndocuPack de la Universidad de Nevada, Reno, que proporciona apoyo a los estudiantes indocumentados. 

La carta expresa la preocupación de que la oficina pueda estar guiando los estudiantes hacia ayudas económicas, becas y oportunidades profesionales, lo que podría entrar en conflicto con las restricciones federales sobre las prestaciones para inmigrantes indocumentados en virtud de la Ley de Reconciliación de la Responsabilidad Personal y la Oportunidad Laboral de 1996.

El presidente de la Universidad de Nevada, Reno, Brian Sandoval, también fue informado del asunto, que ha sido remitido al Departamento de Educación para su investigación.

La carta sugiere que el programa UndocuPack está violando la ley federal al proporcionar recursos públicos a «extranjeros ilegales» e insta al Departamento de Educación a investigar si la UNR está «utilizando fondos de los contribuyentes [para] subvencionar o promover la inmigración ilegal». También parece citar un artículo reciente publicado en OurTownReno, en el que la directora de UndocuPack, Janet Najera, habló sobre lo que hace el programa.

Desde el 29 de septiembre, la página web y el Instagram de UndocuPack han sido retirados.

La Oficina de Comunicación de la Universidad ha facilitado la siguiente declaración a la Nevada Sagebrush:

“A última hora de la tarde del viernes, la Universidad recibió una carta del Departamento de Justicia de los Estados Unidos. En este momento estamos revisando la carta y responderemos de forma adecuada a través de los canales legales y administrativos correspondientes.

La Universidad mantiene su compromiso de fomentar un entorno universitario inclusivo, solidario y respetuoso para todos nuestros estudiantes. También reconocemos y defendemos nuestras responsabilidades en virtud de la legislación estatal y federal, y seguiremos actuando de conformidad con la Constitución de los Estados Unidos.

Mientras evaluamos la correspondencia del Departamento de Justicia, nuestro objetivo sigue siendo garantizar que todos los estudiantes tengan la oportunidad de alcanzar sus metas educativas y profesionales en un entorno seguro y acogedor.”

“La información relativa al sitio web UndocuPack fue eliminada tras recibir la carta del Departamento de Justicia de los Estados Unidos, lo que nos permite revisar meticulosamente el programa y la información en este momento, garantizando que el programa cumpla con las leyes estatales y federales, y que sea conforme a la Constitución de los Estados Unidos.”

La carta fue enviada por el fiscal general adjunto de los Estados Unidos, Harmeet Dhillon, y el fiscal interino del distrito de Nevada, Sigal Chattah. La legalidad del cargo de Chattah como fiscal interino está siendo impugnada actualmente en la corte, y se espera que un juez federal tome una decisión al respecto a finales de septiembre.

Otras universidades de Nevada se han enfrentado a recortes en la financiación federal debido al mayor escrutinio de la administración Trump sobre las iniciativas de apoyo a los estudiantes marginalizados.

El programa TRIO del College of Southern Nevada, que apoya a los estudiantes universitarios de primera generación, finalizó después de que la administración recortara su financiación, alegando que “las actividades propuestas tienen en cuenta la raza de una manera que entra en conflicto con la política del Departamento de dar prioridad al mérito, la equidad y la excelencia en la educación.” La Universidad de Nevada, Las Vegas, también ha sufrido recortes en la financiación de su programa TRIO.

En la Universidad Estatal de Nevada, la Oficina de Comunidad, Equidad, Diversidad e Inclusión de la institución fue cerrada en mayo de este año. La administración afirmó que el cierre se había estado gestando desde hacía tiempo, pero según el reportaje del Nevada Current, algunos estudiantes y profesores lo ven en el contexto de la presión nacional para desmantelar las iniciativas de diversidad.
